These Terms of Service ("Terms") govern your access to and use of the BriefPal.ai service ("Service") operated by BriefPal ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

BriefPal is an AI-powered intelligence briefing service. You submit content — articles, reports, PDFs, podcast URLs, video links — and BriefPal generates structured text briefs and audio narrations. The Service also maintains a personal knowledge base that tracks what you have consumed and scores new content for novelty.

2. Account Terms

• You must be at least 18 years old to use BriefPal.
• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• One person or entity per account. Shared accounts are not permitted.

3. Acceptable Use

You agree not to use BriefPal to:

• Submit content that you do not have the right to access or process.
• Submit content that is illegal, defamatory, or infringes on the rights of others.
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms.
• Use the Service to generate content for automated systems, scraping, or bulk redistribution.
• Overload, disrupt, or interfere with the Service or its infrastructure.
• Share your account access with others or resell the Service.

4. Content and Intellectual Property

Your Content: You retain full ownership of the content you submit to BriefPal and the briefs generated from that content. BriefPal does not claim any intellectual property rights over your inputs or outputs.

Our Service: BriefPal, including its design, features, AI models, and underlying technology, is our intellectual property. These Terms do not grant you any rights to our trademarks, branding, or proprietary technology.

License to Process: By submitting content, you grant us a limited, non-exclusive license to process that content solely for the purpose of generating your briefs and maintaining your knowledge base. This license terminates when you delete the content or your account.

5. Subscription and Payment

• BriefPal is offered as a monthly subscription at the price listed on our website (currently $100/month).
• Payment is charged at the beginning of each billing cycle.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods.
• We reserve the right to change our pricing with 30 days' advance notice.

6. Service Availability and Modifications

We strive to keep BriefPal available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. For material changes that negatively affect your use, we will provide reasonable advance notice.

7. Limitation of Liability

To the maximum extent permitted by applicable law, BriefPal and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to BriefPal in the 12 months preceding the claim.

8. Disclaimers

• AI Accuracy: BriefPal uses artificial intelligence to generate briefs and audio. While we strive for accuracy, AI-generated content may contain errors, omissions, or misinterpretations. You should verify critical information from original sources before making important decisions based on a brief.
• Not Professional Advice: BriefPal briefs are informational summaries, not professional, legal, financial, or medical advice. We are not responsible for decisions made based on AI-generated content.
• As-Is: The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

9. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. Upon termination, your right to access the Service ceases immediately. You may request an export of your data within 30 days of termination.

10. Governing Law

These Terms are governed by the laws of Switzerland. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.

11. Dispute Resolution

Before pursuing formal legal action, you agree to attempt to resolve any dispute informally by reaching out via our contact form. We will work in good faith to resolve the matter within 30 days.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 14 days before the changes take effect. Your continued use of BriefPal after the changes become effective constitutes acceptance of the updated Terms.
